1. Agreement to Terms

By accessing or using Azion Cloud's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Service Description

Azion Cloud provides premium cloud hosting services including but not limited to:

  • Minecraft game server hosting
  • Discord bot hosting
  • Virtual Private Server (VPS) hosting
  • Related hosting services and management tools

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

3. User Accounts and Registration

3.1 Account Creation

To use our services, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

3.3 Age Requirements

You must be at least 13 years of age to use our services. Users between 13 and 18 years of age must have parental or guardian consent.

4. Acceptable Use Policy

4.1 Prohibited Activities

You agree not to use our services for any unlawful purpose or in any way that could harm Azion Cloud, its users, or any third party. Prohibited activities include but are not limited to:

  • Hosting illegal content or engaging in illegal activities
  • Distributing malware, viruses, or other harmful software
  • Launching DDoS attacks or other network attacks
  • Mining cryptocurrency without explicit authorization
  • Hosting adult content, gambling, or phishing websites
  • Violating intellectual property rights
  • Spamming or sending unsolicited communications
  • Attempting to gain unauthorized access to our systems or other users' accounts

4.2 Resource Usage

You must use server resources responsibly and in accordance with your service plan limitations. Excessive resource usage that degrades service quality for other users may result in service suspension.

5. Payment Terms

5.1 Pricing and Billing

Service fees are charged according to the plan you select. All prices are in USD unless otherwise stated. We reserve the right to change our pricing with 30 days' notice to existing customers.

5.2 Payment Methods

We accept various payment methods as displayed on our billing portal. Payment processing is handled by third-party payment processors.

5.3 Automatic Renewal

Services automatically renew at the end of each billing cycle unless cancelled before the renewal date. You will be charged automatically using your selected payment method.

5.4 Late Payments

Failure to pay on time may result in service suspension or termination. Late fees may apply as specified in your service agreement.

6. Service Level Agreement (SLA)

6.1 Uptime Guarantee

We strive to maintain a 99.9% uptime guarantee for our services. Planned maintenance is excluded from uptime calculations and will be announced in advance when possible.

6.2 DDoS Protection

Our services include industry-leading DDoS protection. However, we cannot guarantee complete immunity from all attacks and reserve the right to null-route IPs under severe attack to protect our network infrastructure.

6.3 Support

We provide 24/7 support through our Discord server and ticket system. Response times vary based on ticket priority and service plan.

7. Data and Backups

7.1 User Responsibility

You are solely responsible for maintaining backups of your data. While we may provide backup tools, we are not liable for any data loss.

7.2 Data Retention

Upon service termination, we will retain your data for 7 days. After this period, all data will be permanently deleted and cannot be recovered.

8. Service Suspension and Termination

8.1 Suspension

We reserve the right to suspend or terminate your services immediately if you violate these Terms of Service, engage in prohibited activities, or fail to pay for services.

8.2 User Termination

You may cancel your services at any time through our billing portal. Cancellations take effect at the end of your current billing period.

8.3 Effects of Termination

Upon termination, your access to services will be revoked, and data retention policies will apply as described in Section 7.2.

9. Intellectual Property

All content, features, and functionality of Azion Cloud services, including but not limited to text, graphics, logos, and software, are owned by Azion Cloud and are protected by intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, Azion Cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our services.

Our total liability to you for any claims arising from your use of our services shall not exceed the amount you paid us in the six months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Azion Cloud, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of our services or violation of these Terms of Service.

12. Dispute Resolution

12.1 Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable international laws and regulations.

12.2 Arbitration

Any disputes arising from these terms or our services shall be resolved through binding arbitration rather than in court, except where prohibited by law.

13. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes via email or through our service dashboard. Continued use of our services after changes constitutes acceptance of the modified terms.
